The Prospective Marriage Visa is now available to same sex partners as are the two other classes of partner visas. These are suitable for onshore and offshore applicants. Main application criteria and requirements are listed below.

Members of the LGBTIQ community may apply for partner visas available through the Australian visa program. The following classes of visas are included in the visa partner program:

Offshore Marriage Visa | Subclass 300

Offshore Partner Visa | Subclass 309

Offshore Partner Visa | Subclass 100

Onshore Partner Visa | Subclass 820

Requirements and criteria to be satisfied for partner visas are no different to that of opposite sex or same sex couples. Two main criteria to be met focus on the relationship, and whether the couple meet de facto requirements.

The relationship should be genuine and ongoing; the couple are required to show evidence they are committed to each other to the exclusion of all others. 

Australian Law, (since December 2017) recognises Gay Marriage & Civil Partnerships. This change ensures gay couples may now apply for ful range of partner visas. 

The same-sex couple are required to show evidence clearly demonstrating that the couple are in a durable and long lasting relationship, such as living together on a permanent basis, and sharing important financial and social commitments.

ONSHORE

Partner Visa

Same Sex | Partner Visa | Subclass 820/801

Visa application usually involves two stage process; initially the applicant applies for temporary subclass 820. Later the permanent, final stage subclass 801 will be decided by the department. 

Same Sex | SPONSOR

An Australian citizen, permanent resident or eligible New Zealand resident will need to sponsor the partner/applicant. The applicant must be in Australia when making an application for this visa.

OFFSHORE

Prospective Marriage Visa

 Prospective Marriage Visa | Subclass 300 

Now available to same sex & LGBTIQ Community this visa is suitable for gay couples who wish to marry. Valid for 9 months the applicant should be outside Australia when papers are lodged for Prospective Marriage - subclass 300 visa.

Same Sex | Sponsor

An Australian citizen, permanent resident or eligible New Zealand resident will need to sponsor the prospective spouse/applicant.

Features

Parties should intend to marry in accordance with Australian law - this visa not open to same sex couples

Sponsor/spouse should have met and know each other personally

Valid for 9 months - cannot be extended

Pathway to 820/801 permanent visa

Applicant must be outside Australia

Decision: 5 months +

OFFSHORE

Partner Visa

Partner Visa | A Visa For Two

Australian Department of Immigration & Border Protection is responsible for the grant all Partner visas in the 2018 program. The primary requisite of this visa category is that the same sex spouse/partner are to be sponsored by an Australian person already  settled in this country.  De Facto arrangements are another main element of the criteria; with correct planning and advice these requirements can be meet to ensure a valid visa application.
